BLACK PHOENIX TACTICAL SOLUTIONS LLC RETURN POLICY (ONLINE PURCHASES)
All firearms returned will be at cost of buyer. No refund will be issued. Black Phoenix Tactical Solutions LLC is not responsible for any malfunctions to orders. All returned items will incur a restocking fee of $25 or 25%, whichever is greater. Shipping and handling charges will not be refunded unless an error occurred on our part in the shipment of your order.
Product must be returned within 20 days of the date of purchase with the order receipt. If the product is returned, it needs to be in original packaging, with all manuals and accompanying accessories and unused. Any product that has been altered in any way will not be accepted.
For items damaged in shipment, email Blackphoenixtactical@gmail.com before returning.
Black Phoenix Tactical Solutions LLC is not liable for any packages lost or damaged. Please insure your package for at least the value of the item before shipping.
*IF DENIED DURING BACKGROUND CHECK*
Prior to purchasing a firearm, you need to be sure you will pass a Background Check and otherwise be qualified to purchase a firearm under State and Federal Laws. If you are denied during the Background Check, you will be charged a fee of $150.
SHIPPING RESTRICTIONS
Due to shipping restrictions and international, federal, state and/or local laws we are unable to list every restriction here. Please e-mail with any further questions.
Black Phoenix Tactical Solutions LLC does not ship any product to international addresses, no exceptions. In addition, Federal, State and/or local law may further restrict some of the products which Black Phoenix Tactical Solutions LLC offers for sale. Please check your state and local laws for restrictions before ordering. Size and/or weight of the product may also restrict it from being shipped. The product may have to be picked up in our store.
FIREARMS TRANSFERS
We cannot ship firearms directly to a customer. We will ship to the local FFL dealer of your choice. Any legitimate gun store or dealer has an FFL license; pawn shops and collectors may also have them. It is your responsibility to contact a local FFL dealer and arrange the transfer with them and to forward a copy of the FFL and all pertinent contact information to us, either via post or e-mail. Be aware that it is customary for your local dealer to charge a transaction fee at the time you pick up your purchase. This transfer fee is strictly between you and your local dealer. By purchasing a firearm from us, you acknowledge that you may have to pay your dealer a fee for transferring the firearm to you.
Arranging for a Shipment & Transfer:
(1) Find a licensed FFL dealer in your area. Contact the dealer and let them know you would like to arrange a transfer from Black Phoenix Tactical Solutions LLC Be sure to ask about their FFL transfer fee.
(2) Arrange the transfer with your FFL dealer (we do not arrange the transfer) and provide your dealer with our mailing address or e-mail address where they can send a copy of their FFL.
(3) Once you have selected an FFL for your transfer, please indicate the dealer’s name (on their FFL) on your order so we know where to ship your firearm. Please include your ORDER NUMBER on any correspondence you or your FFL may send us.
(4) It is best to locate an FFL dealer before you place your order; however, you can place your order first and then provide us with your FFL dealer info before we ship. We will hold your order until we have the required information.

FIREARM POLICIES
Damaged or Defective Firearms
(1) BEFORE the firearm is transferred to you: Firearm returns can be accepted for any that are damaged or defective. Return on the firearm will only be accepted immediately upon receipt by the dealer, but must happen before the transfer takes place. It is VERY IMPORTANT that you take your time to thoroughly inspect your firearm BEFORE proceeding with the transfer. Once a firearm has been transferred to you, it CANNOT be returned to Black Phoenix Tactical Solutions LLC . If the defect(s) is found BEFORE the transfer, Black Phoenix Tactical Solutions LLC will exchange the firearm (subject to availability and applicable fees). Black Phoenix Tactical Solutions LLC will not refund the shipping or transfer fees originally incurred on the purchase, however we will cover return shipping costs.
(2) AFTER the firearm is transferred to you: Once the dealer has transferred a firearm to the consumer, it CANNOT be returned to Black Phoenix Tactical Solutions LLC. After the transfer, Black Phoenix Tactical Solutions LLC cannot refund the purchase price. We understand some manufacturer defects/problems may not be identifiable upon initial inspection. However, if the defect(s) is found AFTER the transfer, the firearm must be returned directly to the manufacturer for replacement or repair, subject to that manufacturer’s policies. Black Phoenix Tactical Solutions LLC will help you by providing contact information for the firearm manufacturer to help you with any warranty repairs or returns.

Please call or email Black Phoenix Tactical Solutions LLC before sending any product back for warranty service.
To obtain service under Black Phoenix Tactical Solutions LLC Limited Warranty, you must be the original purchaser/user of the product and you must obtain a Return Merchandise Authorization (RMA) code number from Black Phoenix Tactical Solutions LLC Products must be returned to Black Phoenix Tactical Solutions with transportation charges prepaid within 30 days of your identification of the product deficiency and must be accompanied by Black Phoenix Tactical Solutions return shipping form including a description of the issues and steps taken to troubleshoot. Black Phoenix Tactical Solutions will provide a shipping label if the issue noted is troubleshooted to be and likely caused by Black Phoenix Tactical Solutions LLC. All shipments to and from Black Phoenix Tactical Solutions LLC are via common carrier ground, unless explicitly authorized.
Please note that Black Phoenix Tactical Solutions LLC will only accept back Black Phoenix Tactical Solutions LLC products. For example, we will not accept complete receivers or assemblies with other manufacturer’s components.
Black Phoenix Tactical Solutions LLC will directly service repair or replacements of components purchased through dealers, distributors, or authorized third parties. However, for refunds for purchases through dealers, distributors, or third parties must be returned to the selling entity. We do not directly refund customers for the entire order value through a dealer, distributor, or third party.
While not required to take advantage of our Lifetime Guarantee, registering your product expedites the process, should a problem arise with your product.
BLACK PHOENIX TACTICAL SOLUTIONS LLC LIMITED WARRANTY DOES NOT APPLY TO NORMAL WEAR OR TO DAMAGE RESULTING FROM ACCIDENT, MISUSE, ABUSE OR NEGLECT, INCLUDING, WITHOUT LIMITATION, FAILURE TO FOLLOW CLEANING AND MAINTENANCE PROCEDURES DESCRIBED IN THE PRODUCT MANUALS. BLACK PHOENIX TACTICAL SOLUTIONS LLC MAKES NO WARRANTIES OTHER THAN THE LIMITED WARRANTY EXPRESSLY SET FORTH IN THE LIMITED WARRANTY CERTIFICATE. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES, INCLUDING ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED; AND BLACK PHOENIX TACTICAL SOLUTIONS LLC'S WARRANTY EXPRESSLY EXCLUDES ALL INCIDENTAL AND CONSEQUENTIAL DAMAGES. (Some states do not allow limitations or exclusion of implied warranties, and some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. 100% Satisfaction Return Policy. Your direct Black Phoenix Tactical Solutions LLC purchase is subject to your satisfaction. However, your duty is to inspect the purchase to your satisfaction within 10 days from the date of purchase. If you are not satisfied and wish to return the purchase, you must notify us within that time period (10 days). You will receive a Return Merchandise Authorization (RMA) code which you must include on the inside and outside of the package returning the product. You must have the original packaging, proof of date and amount of purchase, and you must be the original purchaser. Upon return to Black Phoenix Tactical Solutions LLC of the purchase, Black Phoenix Tactical Solutions LLC will refund to you, by credit or by payment, the original purchase price, exclusive of shipping, restocking fees, or taxes.
Exclusive Remedy: Acceptance: Your exclusive remedy and Black Phoenix Tactical Solutions LLC sole obligation is complying with the foregoing Refund and Repair Policies within the respective warranty periods. Purchaser's failure to make a claim as provided in this Certificate or continued use of the product shall constitute an unqualified acceptance of such product and a waiver by you of all claims thereto.
Proof of Purchase: The Purchaser's dated invoice and evidence of payment must be retained as evidence of the date of purchase and to establish warranty eligibility.
Product Registration: Registration of any product or of this limited warranty is voluntary; failure to register will not diminish any rights available under this warranty.
Disclaimer of Warranty
EXCEPT FOR THE FOREGOING WARRANTIES, BLACK PHOENIX TACTICAL SOLUTIONS LLC HEREBY DISCLAIMS AND EXCLUDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO ANY AND/OR ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR ANY WARRANTY WITH REGARD TO ANY CLAIM OF INFRINGEMENT THAT MAY BE PROVIDED IN SECTION 2-312(3) OF THE UNIFORM COMMERCIAL CODE AND/OR IN ANY OTHER COMPARABLE STATE STATUTE. BLACK PHOENIX TACTICAL SOLUTIONS LLC HEREBY DISCLAIMS ANY REPRESENTATIONS OR WARRANTY THAT THE PRODUCT IS COMPATIBLE WITH ANY COMBINATION OF NON BLACK PHOENIX TACTICAL SOLUTIONS LLC PRODUCTS OTHER THAN AS EXPRESSLY SET FORTH IN THE PRODUCT MANUAL.
Limitation of Liability
THE LIABILITY OF BLACK PHOENIX TACTICAL SOLUTIONS LLC , IF ANY, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR DAMAGES FOR ANY CLAIM OF ANY KIND WHATSOEVER, REGARDLESS OF THE LEGAL THEORY AND WHETHER ARISING IN TORT OR CONTRACT, SHALL NOT BE GREATER THAN THE ACTUAL PURCHASE PRICE OF THE PRODUCT WITH RESPECT TO WHICH SUCH CLAIM IS MADE. IN NO EVENT SHALL BLACK PHOENIX TACTICAL SOLUTIONS LLC BE LIABLE TO PURCHASER FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, COMPENSATION, REIMBURSEMENT OR DAMAGES ON ACCOUNT OF THE LOSS OF PRESENT OR PROSPECTIVE PROFITS OR FOR ANY OTHER REASON WHATSOEVER.
MODIFICATION WARNINGS
Customer Discretion: It is your responsibility to make sure any parts you buy are made for our uppers and barrels, are installed properly, and that neither the original or replacement parts are altered or changed. If you are not comfortable installing these components, please consult with a local gunsmith.
